The U.S. Commodity Futures Trading Commission (CFTC) requested a preliminary injunction against the defendant Timothy Stubbs for violating the Commodity Exchange Act and related CFTC regulations.。The court found that the Commission had sufficiently demonstrated that Stubbs, through a joint venture with its co-defendants, had violated 7 U.S.C. § 6b (a) (2) (A), (C), 6d (a) (1), 9 (1), and 17 C..F.R.Section。R.§ § 5.2 (b) (1), (3) and 180.1 (a), because they accepted and misappropriated client funds that the client intended to use for retail foreign exchange transactions and failed to disclose material facts to the client。Therefore, until the litigation is resolved, it is necessary to issue a preliminary injunction to maintain the status quo。
