CySEC reminds investment firms of new Spanish CFD rules

Cyprus Securities and Exchange Commission (CySEC) urges Cyprus Investment Companies (CIF) to take note of the CNMV Resolution of 11 July 2023 concerning product intervention measures for CFDs and other leveraged products targeting retail investors in Spain。
The CNMV's resolution prohibits the promotion of CFDs and other leverage instruments to retail investors and prohibits certain compensation policies and sales practices.。In addition, interventions for marketing, sales and distribution of other leverage instruments have been developed。
These measures, which came into force on 3 August 2023, apply to all entities authorized to provide investment services in Spain in connection with the marketing, distribution and sale of the subject tools and services to retail investors in Spain, regardless of the origin of the investment company marketing and distributing such products and regardless of whether it has a branch in Spain (thus including entities that do not have institutional freedom to provide services).。
CySEC urges all CIF marketing, distributing and selling CFDs and other leveraged products to retail investors in Spain to take all appropriate actions and measures to comply with CNMV's resolution。
